Hadith 4591 — Livre 41: Types of Blood-Wit (Kitab Al-Diyat)

Rapporté par Abdullah ibn Abbas رضي الله عنه : Le Prophète ﷺ a dit : « Si quelqu’un est tué accidentellement ou, alors que des gens lancent des pierres, par une pierre ou un fouet, le prix du sang est celui d’un meurtre involontaire. Mais si quelqu’un est tué intentionnellement, la loi du talion s’applique. Si quelqu’un essaie de l’empêcher, la malédiction d’Allah, des anges et de tous les gens sera sur lui. »

قَالَ أَبُو دَاوُدَ حُدِّثْتُ عَنْ سَعِيدِ بْنِ سُلَيْمَانَ، عَنْ سُلَيْمَانَ بْنِ كَثِيرٍ، حَدَّثَنَا عَمْرُو بْنُ دِينَارٍ، عَنْ طَاوُسٍ، عَنِ ابْنِ عَبَّاسٍ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " مَنْ قُتِلَ فِي عِمَّيَّا أَوْ رَمْيًا يَكُونُ بَيْنَهُمْ بِحَجَرٍ أَوْ بِسَوْطٍ فَعَقْلُهُ عَقْلُ خَطَإٍ وَمَنْ قُتِلَ عَمْدًا فَقَوْدُ يَدَيْهِ فَمَنْ حَالَ بَيْنَهُ وَبَيْنَهُ فَعَلَيْهِ لَعْنَةُ اللَّهِ وَالْمَلاَئِكَةِ وَالنَّاسِ أَجْمَعِينَ " .
Traduction anglaise
Narrated Abdullah ibn Abbas: The Prophet (ﷺ) said: If anyone is killed blindly or, when people are throwing stones, by a stone or a whip, his blood-wit is the blood-wit for an accidental murder. But if anyone is killed intentionally, retaliation is due. If anyone tries to prevent it, the curse of Allah, of angels, and of all the people will rest on him
Traduction en ourdou
عبداللہ بن عباس رضی اللہ عنہما کہتے ہیں کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: جو شخص اندھا دھند مارا جائے یا کسی دنگے فساد میں جو ان میں چھڑ گیا ہو، یا کسی پتھر یا کوڑے سے مارا جائے تو اس کی دیت قتل خطا کی دیت ہو گی، اور جو جان بوجھ کر عمداً کسی کو قتل کرے تو وہ موجب قصاص ہے، اب اگر کوئی ان دونوں کے بیچ میں پڑ کر ( قاتل کو بچانا چاہے ) تو اس پر اللہ کی، فرشتوں کی اور تمام لوگوں کی لعنت ہے ۔
