Hadith 4484 — Livre 40: Prescribed Punishments (Kitab Al-Hudud)

Rapporté par Abu Hurayrah رضي الله عنه : Le Prophète ﷺ a dit : « S’il est ivre, fouettez-le ; s’il est encore ivre, fouettez-le ; s’il est encore ivre, fouettez-le ; s’il recommence une quatrième fois, tuez-le. » Abu Dawud a dit : Il existe un récit similaire de Umar ibn Abu Salamah, de son père, d’après Abu Hurayrah, du Prophète ﷺ : « S’il boit du vin, fouettez-le ; s’il recommence, une quatrième fois, tuez-le. » Abu Dawud a dit : Il existe aussi un récit similaire de Suhail, de Abu Salih, d’après Abu Hurayrah, du Prophète ﷺ : « S’ils boivent une quatrième fois, tuez-les. » Il existe aussi un récit similaire de Ibn Abi Nu’m, d’après Ibn ‘Umar, du Prophète ﷺ. Il y a aussi un récit similaire de ‘Abd Allah b. ‘Amr, du Prophète ﷺ, et de Sharid, du Prophète ﷺ. Et dans le récit d’al-Jadli, de Mu’awiyah, le Prophète ﷺ a dit : « S’il recommence une troisième ou une quatrième fois, tuez-le. »

حَدَّثَنَا نَصْرُ بْنُ عَاصِمٍ الأَنْطَاكِيُّ، حَدَّثَنَا يَزِيدُ بْنُ هَارُونَ الْوَاسِطِيُّ، حَدَّثَنَا ابْنُ أَبِي ذِئْبٍ، عَنِ الْحَارِثِ بْنِ عَبْدِ الرَّحْمَنِ، عَنْ أَبِي سَلَمَةَ، عَنْ أَبِي هُرَيْرَةَ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " إِذَا سَكِرَ فَاجْلِدُوهُ ثُمَّ إِنْ سَكِرَ فَاجْلِدُوهُ ثُمَّ إِنْ سَكِرَ فَاجْلِدُوهُ فَإِنْ عَادَ الرَّابِعَةَ فَاقْتُلُوهُ " . قَالَ أَبُو دَاوُدَ وَكَذَا حَدِيثُ عُمَرَ بْنِ أَبِي سَلَمَةَ عَنْ أَبِيهِ عَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ صلى الله عليه وسلم " إِذَا شَرِبَ الْخَمْرَ فَاجْلِدُوهُ فَإِنْ عَادَ الرَّابِعَةَ فَاقْتُلُوهُ " . قَالَ أَبُو دَاوُدَ وَكَذَا حَدِيثُ سُهَيْلٍ عَنْ أَبِي صَالِحٍ عَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ صلى الله عليه وسلم " إِنْ شَرِبُوا الرَّابِعَةَ فَاقْتُلُوهُمْ " . وَكَذَا حَدِيثُ ابْنِ أَبِي نُعْمٍ عَنِ ابْنِ عُمَرَ عَنِ النَّبِيِّ صلى الله عليه وسلم وَكَذَا حَدِيثُ عَبْدِ اللَّهِ بْنِ عَمْرٍو عَنِ النَّبِيِّ صلى الله عليه وسلم وَالشَّرِيدِ عَنِ النَّبِيِّ صلى الله عليه وسلم وَفِي حَدِيثِ الْجَدَلِيِّ عَنْ مُعَاوِيَةَ أَنَّ النَّبِيَّ صلى الله عليه وسلم قَالَ " فَإِنْ عَادَ فِي الثَّالِثَةِ أَوِ الرَّابِعَةِ فَاقْتُلُوهُ " .
Traduction anglaise
Narrated AbuHurayrah: The Prophet (ﷺ) said: If he is intoxicated, flog him; again if he is intoxicated, flog him; again if he is intoxicated, flog him if he does it again a fourth time, kill him. Abu Dawud said: And there is a similar tradition of Umar ibn AbuSalamah, from his father, on the authority of AbuHurayrah, from the Prophet (ﷺ): If he drinks wine, flog him if he does it so again, a fourth time, kill him. Abu Dawud said: And there is similar tradition of Suhail from Abu Salih on the authority of Abu Hurairah, from the Prophet (ﷺ): It they drink a fourth time, kill them. And there is similar tradition of Ibn Abi Nu'm on the authority of Ibn 'Umar from Prophet (ﷺ). There is also similar tradition of 'Abd Allah b. 'Amr from the Prophet (ﷺ), and from Sharid from the Prophet (ﷺ). And in the tradition of al-Jadli from Mu'awiyah, the Prophet (ﷺ) said: If he does so again third or fourth time, kill him

ابوہریرہ رضی اللہ عنہ کہتے ہیں کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: شرابی جب نشہ سے مست ہو جائے تو اسے کوڑے مارو، پھر اگر نشہ سے مست ہو جائے تو اسے پھر کوڑے مارو، پھر اگر نشہ سے مست ہو جائے تو اسے پھر کوڑے مارو، اور اگر چوتھی بار پھر ایسا ہی کرے تو اسے قتل کر دو ۔ ابوداؤد کہتے ہیں: اسی طرح عمر بن ابی سلمہ کی روایت ہے جسے وہ اپنے والد سے اور ابوسلمہ ابوہریرہ سے اور ابوہریرہ نبی اکرم صلی اللہ علیہ وسلم سے روایت کرتے ہیں کہ کوئی شراب پئے تو اسے کوڑے لگاؤ، اور اگر چوتھی بار پھر ویسے ہی کرے تو اسے قتل کر دو۔ ابوداؤد کہتے ہیں: اسی طرح سہیل کی حدیث ہے جسے وہ ابوصالح سے اور ابوصالح ابوہریرہ سے اور ابوہریرہ نبی اکرم صلی اللہ علیہ وسلم سے روایت کرتے ہیں کہ اگر وہ چوتھی دفعہ پئے تو اسے قتل کر دو ۔ اور اسی طرح ابن ابی نعم کی روایت بھی ہے جسے وہ ابن عمر رضی اللہ عنہما سے اور ابن عمر نبی اکرم صلی اللہ علیہ وسلم سے روایت کرتے ہیں۔ اور اسی طرح عبداللہ بن عمرو رضی اللہ عنہما اور شرید رضی اللہ عنہ کی مرفوع روایت بھی ہے، اور جدلی کی روایت میں ہے جسے وہ معاویہ رضی اللہ عنہ سے روایت کرتے ہیں کہ نبی اکرم صلی اللہ علیہ وسلم نے فرمایا: اگر وہ تیسری یا چوتھی بار پھر کرے تو اسے قتل کر دو ۔
