Hadith 3051 — Livre 20: Tribute, Spoils, and Rulership (Kitab Al-Kharaj, Wal-Fai' Wal-Imarah)
كتاب الخراج والإمرة والفيء
Rapporté par un homme de Juhaynah : Le Prophète ﷺ a dit : « Il se peut que vous combattiez un peuple, que vous les dominiez, et qu’ils se protègent, eux et leurs enfants, en vous donnant leurs biens. » Dans la version de Sa’id, il est ajouté : « Vous conclurez alors la paix avec eux. » La version convenue dit : « Ne prenez alors rien de plus que cela, car il ne vous est pas permis de le faire. »

حَدَّثَنَا مُسَدَّدٌ، وَسَعِيدُ بْنُ مَنْصُورٍ، قَالاَ حَدَّثَنَا أَبُو عَوَانَةَ، عَنْ مَنْصُورٍ، عَنْ هِلاَلٍ، عَنْ رَجُلٍ، مِنْ ثَقِيفٍ عَنْ رَجُلٍ، مِنْ جُهَيْنَةَ قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " لَعَلَّكُمْ تُقَاتِلُونَ قَوْمًا فَتَظْهَرُونَ عَلَيْهِمْ فَيَتَّقُونَكُمْ بِأَمْوَالِهِمْ دُونَ أَنْفُسِهِمْ وَأَبْنَائِهِمْ " . قَالَ سَعِيدٌ فِي حَدِيثِهِ " فَيُصَالِحُونَكُمْ عَلَى صُلْحٍ " . ثُمَّ اتَّفَقَا " فَلاَ تُصِيبُوا مِنْهُمْ شَيْئًا فَوْقَ ذَلِكَ فَإِنَّهُ لاَ يَصْلُحُ لَكُمْ " .
Traduction anglaise
Narrated A man of Juhaynah: The Prophet (ﷺ) said: Probably you will fight with a people, you will dominate them, and they will save themselves and their children by their property. The version of Sa'id has You will then conclude peace with them. The agreed version goes: Then do no take anything from them more than that, for it is not proper for you

جہینہ کے ایک شخص کہتے ہیں کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ایسا ہو سکتا ہے کہ تم ایک قوم سے لڑو اور اس پر غالب آ جاؤ تو وہ تمہیں مال ( جزیہ ) دے کر اپنی جانوں اور اپنی اولاد کو تم سے بچا لیں ۔ سعید کی روایت میں ہے: «فيصالحونكم على صلح» پھر وہ تم سے صلح پر مصالحت کر لیں پھر ( مسدد اور سعید بن منصور دونوں راوی آگے کی بات پر ) متفق ہو گئے کہ: جتنے پر مصالحت ہو گئی ہو اس سے زیادہ کچھ بھی نہ لینا کیونکہ یہ تمہارے واسطے درست نہیں ہے۔
