Rapporté par Huzail ibn Shurahbil al-Awadi : Un homme est venu voir Abu Musa al-Ash'ari et Salman ibn Rabi'ah et leur a demandé ce qu’il fallait faire dans le cas où il y a une fille, une petite-fille (fille du fils) et une sœur germaine. Ils ont répondu : « La fille reçoit la moitié et la sœur germaine reçoit la moitié. La petite-fille ne reçoit rien. Va voir Ibn Mas'ud et tu verras qu’il est d’accord avec moi. » L’homme est donc allé le voir et lui a exposé leur avis. Il a dit : « Je serais alors dans l’erreur et je ne ferais pas partie des bien-guidés. Mais je juge la question comme l’a fait le Messager d’Allah ﷺ : la fille reçoit la moitié, la petite-fille reçoit une part pour compléter les deux tiers (c’est-à-dire un sixième), et le reste va à la sœur germaine. »

حَدَّثَنَا عَبْدُ اللَّهِ بْنُ عَامِرِ بْنِ زُرَارَةَ، حَدَّثَنَا عَلِيُّ بْنُ مُسْهِرٍ، عَنِ الأَعْمَشِ، عَنْ أَبِي قَيْسٍ الأَوْدِيِّ، عَنْ هُزَيْلِ بْنِ شُرَحْبِيلَ الأَوْدِيِّ، قَالَ جَاءَ رَجُلٌ إِلَى أَبِي مُوسَى الأَشْعَرِيِّ وَسَلْمَانَ بْنِ رَبِيعَةَ فَسَأَلَهُمَا عَنِ ابْنَةٍ وَابْنَةِ ابْنٍ وَأُخْتٍ، لأَبٍ وَأُمٍّ فَقَالاَ لاِبْنَتِهِ النِّصْفُ وَلِلأُخْتِ مِنَ الأَبِ وَالأُمِّ النِّصْفُ وَلَمْ يُوَرِّثَا ابْنَةَ الاِبْنِ شَيْئًا وَأْتِ ابْنَ مَسْعُودٍ فَإِنَّهُ سَيُتَابِعُنَا فَأَتَاهُ الرَّجُلُ فَسَأَلَهُ وَأَخْبَرَهُ بِقَوْلِهِمَا فَقَالَ لَقَدْ ضَلَلْتُ إِذًا وَمَا أَنَا مِنَ الْمُهْتَدِينَ وَلَكِنِّي سَأَقْضِي فِيهَا بِقَضَاءِ النَّبِيِّ صلى الله عليه وسلم لاِبْنَتِهِ النِّصْفُ وَلاِبْنَةِ الاِبْنِ سَهْمٌ تَكْمِلَةُ الثُّلُثَيْنِ وَمَا بَقِيَ فَلِلأُخْتِ مِنَ الأَبِ وَالأُمِّ .
Traduction anglaise
Narrated Huzail b. Shurahbil al-Awadi:A man came to Abu Musa al-Ash'ari and Salman b. Rabi'ah, and asked about a case where there were a daughter, a son's daughter and full sister. They replied: The daughter gets half and the full gets half. The son's daughter gets nothing. Go to Ibn Mas'ud and you will find that he agrees with me. So the man came to him and informed him about their opinion. He said: I would then be in error and not be one of those who are rightly guided. But I decide concerning the matter as the Messenger of Allah (ﷺ) did: The daughter gets half, and the son's daughter gets a share which complete thirds (i.e. gets a sixth), and what remain to the full sister

ہزیل بن شرحبیل اودی کہتے ہیں ایک شخص ابوموسیٰ اشعری رضی اللہ عنہ اور سلیمان بن ربیعہ کے پاس آیا اور ان دونوں سے یہ مسئلہ پوچھا کہ ایک بیٹی ہو اور ایک پوتی اور ایک سگی بہن ( یعنی ایک شخص ان کو وارث چھوڑ کر مرے ) تو اس کی میراث کیسے بٹے گی؟ ان دونوں نے جواب دیا کہ بیٹی کو آدھا اور سگی بہن کو آدھا ملے گا، اور انہوں نے پوتی کو کسی چیز کا وارث نہیں کیا ( اور ان دونوں نے پوچھنے والے سے کہا ) تم عبداللہ بن مسعود رضی اللہ عنہ سے بھی جا کر پوچھو تو وہ بھی اس مسئلہ میں ہماری موافقت کریں گے، تو وہ شخص ان کے پاس آیا اور ان سے پوچھا اور انہیں ان دونوں کی بات بتائی تو انہوں نے کہا: تب تو میں بھٹکا ہوا ہوں گا اور راہ یاب لوگوں میں سے نہ ہوں گا، لیکن میں تو رسول اللہ صلی اللہ علیہ وسلم کے فیصلہ کے مطابق فیصلہ کروں گا، اور وہ یہ کہ بیٹی کا آدھا ہو گا اور پوتی کا چھٹا حصہ ہو گا دو تہائی پورا کرنے کے لیے ( یعنی جب ایک بیٹی نے آدھا پایا تو چھٹا حصہ پوتی کو دے کر دو تہائی پورا کر دیں گے ) اور جو باقی رہے گا وہ سگی بہن کا ہو گا۔
