Hadith 2179 — Livre 13: Divorce (Kitab Al-Talaq)
كتاب الطلاق
‘Abd Allah ibn Umar رضي الله عنه a dit qu’il avait divorcé de sa femme alors qu’elle avait ses règles, à l’époque du Messager d’Allah ﷺ. ‘Umar ibn Al Khattab رضي الله عنه interrogea alors le Messager d’Allah ﷺ à ce sujet. Le Messager d’Allah ﷺ dit : « Ordonne-lui de la reprendre et de la garder jusqu’à ce qu’elle soit purifiée, puis qu’elle ait un autre cycle et soit de nouveau purifiée. Ensuite, s’il le souhaite, il pourra la divorcer avant d’avoir des rapports avec elle, car c’est ainsi qu’Allah le Glorifié a prescrit la période d’attente pour le divorce des femmes. »

حَدَّثَنَا الْقَعْنَبِيُّ، عَنْ مَالِكٍ، عَنْ نَافِعٍ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ، أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ عَلَى عَهْدِ رَسُولِ اللَّهِ صلى الله عليه وسلم فَسَأَلَ عُمَرُ بْنُ الْخَطَّابِ رَسُولَ اللَّهِ صلى الله عليه وسلم عَنْ ذَلِكَ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ لْيُمْسِكْهَا حَتَّى تَطْهُرَ ثُمَّ تَحِيضَ ثُمَّ تَطْهُرَ ثُمَّ إِنْ شَاءَ أَمْسَكَ بَعْدَ ذَلِكَ وَإِنْ شَاءَ طَلَّقَ قَبْلَ أَنْ يَمَسَّ فَتِلْكَ الْعِدَّةُ الَّتِي أَمَرَ اللَّهُ سُبْحَانَهُ أَنْ تُطَلَّقَ لَهَا النِّسَاءُ " .
Traduction anglaise
‘Abd Allah bin Umar said that he divorced his wife while she was menstruating during the time of the Apostle of Allaah(ﷺ). So ‘Umar bin Al Khattab asked the Apostle of Allaah(ﷺ) about this matter. The Apostle of Allaah(ﷺ) said “Order him, he must take her back and keep her back till she is purified, then has another menstrual period and is purified. Thereafter if he desires he may divorce her before having intercourse with her, for that is the period of waiting which Allaah the Glorified has commanded for the divorce of women.”

عبداللہ بن عمر رضی اللہ عنہما سے روایت ہے کہ انہوں نے رسول اللہ صلی اللہ علیہ وسلم کے زمانے میں اپنی بیوی کو حالت حیض میں طلاق دے دی، تو عمر بن خطاب رضی اللہ عنہ نے رسول اللہ صلی اللہ علیہ وسلم سے اس کے متعلق دریافت کیا، رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: اسے حکم دو کہ وہ اپنی بیوی سے رجوع کر لے، پھر اسے روکے رکھے یہاں تک کہ وہ حیض سے پاک ہو جائے، پھر حیض آ جائے، پھر پاک ہو جائے، پھر اس کے بعد اگر چاہے تو رکھے، ورنہ چھونے سے پہلے طلاق دیدے، یہی وہ عدت ہے جس کا اللہ تعالیٰ نے عورتوں کو طلاق دینے کے سلسلے میں حکم دیا ہے ۱؎ ۔
