Hadith 4497 — Livre 30: The Book of Judicial Decisions
كتاب الأقضية
Rapporté par Hammim ibn Munabbih : Abu Huraira a rapporté de nombreux hadiths du Messager d’Allah ﷺ, et l’un d’eux est le suivant : Un homme a acheté un terrain à un autre, et celui qui a acheté le terrain a trouvé dans celui-ci un pot en terre contenant de l’or. L’acheteur a dit au vendeur : « Prends ton or, car je n’ai acheté que le terrain, pas l’or. » Le vendeur a répondu : « Je t’ai vendu le terrain et tout ce qu’il contient. » Ils ont alors soumis l’affaire à un juge, qui leur a demandé : « Avez-vous des enfants ? » L’un a dit : « J’ai un fils », l’autre a dit : « J’ai une fille. » Le juge a dit : « Mariez le garçon à la fille, dépensez une partie de l’argent pour vous et donnez-en aussi en aumône. »

حَدَّثَنَا مُحَمَّدُ بْنُ رَافِعٍ، حَدَّثَنَا عَبْدُ الرَّزَّاقِ، حَدَّثَنَا مَعْمَرٌ، عَنْ هَمَّامِ بْنِ مُنَبِّهٍ، قَالَ هَذَا مَا حَدَّثَنَا أَبُو هُرَيْرَةَ، عَنْ رَسُولِ اللَّهِ صلى الله عليه وسلم فَذَكَرَ أَحَادِيثَ مِنْهَا وَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " اشْتَرَى رَجُلٌ مِنْ رَجُلٍ عَقَارًا لَهُ فَوَجَدَ الرَّجُلُ الَّذِي اشْتَرَى الْعَقَارَ فِي عَقَارِهِ جَرَّةً فِيهَا ذَهَبٌ فَقَالَ لَهُ الَّذِي اشْتَرَى الْعَقَارَ خُذْ ذَهَبَكَ مِنِّي إِنَّمَا اشْتَرَيْتُ مِنْكَ الأَرْضَ وَلَمْ أَبْتَعْ مِنْكَ الذَّهَبَ . فَقَالَ الَّذِي شَرَى الأَرْضَ إِنَّمَا بِعْتُكَ الأَرْضَ وَمَا فِيهَا - قَالَ - فَتَحَاكَمَا إِلَى رَجُلٍ فَقَالَ الَّذِي تَحَاكَمَا إِلَيْهِ أَلَكُمَا وَلَدٌ فَقَالَ أَحَدُهُمَا لِي غُلاَمٌ وَقَالَ الآخَرُ لِي جَارِيَةٌ . قَالَ أَنْكِحُوا الْغُلاَمَ الْجَارِيَةَ وَأَنْفِقُوا عَلَى أَنْفُسِكُمَا مِنْهُ وَتَصَدَّقَا " .
Traduction anglaise
Hammim b. Munabbih said:Abu Huraira reported (so many) ahadith of Allah's Messenger (ﷺ), and one of them is this: A person bought from another person a piece of land, and the person who had, bought that land found in it an earthen ware which contained gold. The person who had bought the land said (to the seller of the land): Take your gold from me, for I bought only the land from you and not the gold. The man who had sold the land said: I sold the land to you and whatever was in it. They referred the matter to a person. One who was made as a judge said to them: Have you any issue? One of them said: I have a boy, and the other said: I have a young daughter He (the judge) said: Marry this young boy with the girl, and spend something on yourselves and also give (some) charity out of it

ہمام بن منبہ سے روایت ہے ، انہوں نے کہا : یہ احادیث ہیں جو ہمیں حضرت ابوہریرہ رضی اللہ عنہ نے رسول اللہ صلی اللہ علیہ وسلم سے بیان کیں ، انہوں نے چند احادیث بیان کیں ، ان میں یہ بھی تھی ، اور رسول اللہ صلی اللہ علیہ وسلم نے فرمایا : " ایک آدمی نے دوسرے آدمی سے اس کی زمین خریدی تو اس آدمی کو ، جس نے زمین خریدی تھی ، اپنی زمین میں ایک گھڑا ملا جس میں سونا تھا ۔ جس نے زمین خریدی تھی ، اس نے اس ( بیچنے والے ) سے کہا : اپنا سونا مجھ سے لے لو ، میں نے تم سے زمین خریدی تھی ، سونا نہیں خریدا تھا ۔ اس پر زمین بیچنے والے نے کہا : میں نے تو زمین اور اس میں جو کچھ تھا تمہیں بیچ دیا تھا ۔ کہا : وہ دونوں جھگڑا لے کر ایک شخص کے پاس گئے ، تو جس کے پاس وہ جھگڑا لے کر گئے تھے اس نے کہا : کیا تمہاری اولاد ہے؟ ان میں سے ایک نے کہا : میرا ایک لڑکا ہے اور دوسرے نے کہا : میری ایک لڑکی ہے ۔ تو اس نے کہا : ( اس سونے کے ذریعے سے ) لڑکے کا لڑکی سے نکاح کر دو اور اس میں سے اپنے اوپر بھی خرچ کرو اور صدقہ بھی کرو
