Hadith 4424 — Livre 29: The Book of Legal Punishments
كتاب الحدود
Rapporté par Jabir ibn Samura : Alors qu’on amenait Ma’iz ibn Malik devant le Messager d’Allah ﷺ, j’ai vu un homme de petite taille, musclé, sans manteau. Il témoigna contre lui-même quatre fois d’avoir commis l’adultère. Le Messager d’Allah ﷺ lui dit : « Peut-être l’as-tu seulement embrassée ou enlacée ? » Il répondit : « Non, par Dieu, j’ai vraiment commis l’adultère. » Le Prophète ﷺ ordonna alors qu’il soit lapidé à mort, puis fit un discours : « Sachez que lorsque nous partons pour le jihad dans la voie d’Allah, l’un d’entre vous reste en arrière et crie comme un bouc, et donne un peu de lait. Par Allah, si je l’attrape, je le punirai. »

وَحَدَّثَنِي أَبُو كَامِلٍ، فُضَيْلُ بْنُ حُسَيْنٍ الْجَحْدَرِيُّ حَدَّثَنَا أَبُو عَوَانَةَ، عَنْ سِمَاكِ بْنِ، حَرْبٍ عَنْ جَابِرِ بْنِ سَمُرَةَ، قَالَ رَأَيْتُ مَاعِزَ بْنَ مَالِكٍ حِينَ جِيءَ بِهِ إِلَى النَّبِيِّ صلى الله عليه وسلم رَجُلٌ قَصِيرٌ أَعْضَلُ لَيْسَ عَلَيْهِ رِدَاءٌ فَشَهِدَ عَلَى نَفْسِهِ أَرْبَعَ مَرَّاتٍ أَنَّهُ زَنَى فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " فَلَعَلَّكَ " . قَالَ لاَ وَاللَّهِ إِنَّهُ قَدْ زَنَى الأَخِرُ - قَالَ - فَرَجَمَهُ ثُمَّ خَطَبَ فَقَالَ " أَلاَ كُلَّمَا نَفَرْنَا غَازِينَ فِي سَبِيلِ اللَّهِ خَلَفَ أَحَدُهُمْ لَهُ نَبِيبٌ كَنَبِيبِ التَّيْسِ يَمْنَحُ أَحَدُهُمُ الْكُثْبَةَ أَمَا وَاللَّهِ إِنْ يُمْكِنِّي مِنْ أَحَدِهِمْ لأُنَكِّلَنَّهُ عَنْهُ " .
Traduction anglaise
Jabir b. Samura reported:As he was being brought to Allah's Apostle (ﷺ) I saw Ma'iz b. Malik-a short-statured person with strong sinews, having no cloak around him. He bore witness against his own self four times that he had committed adultery, whereupon Allah's Messenger (ﷺ) said: Perhaps (you kissed her or embraced her). He said: No. by God, one deviating (from the path of virtue) has committed adultery. He then got him stoned (to death), and then delivered the address: Behold, as we set out for Jihad in the cause of Allah, one of you lagged behind and shrieked like the bleating of a male goat, and gave a small quantity of milk. By Allah, in case I get hold of him, I shall certainly punish him

ابو عوانہ نے سماک بن حرب سے ، انہوں نے حضرت جابر بن سمرہ رضی اللہ عنہ سے روایت کی ، انہوں نے کہا : میں نے ماعز بن مالک کو ، جب وہ نبی صلی اللہ علیہ وسلم کے سامنے پیش کیے گئے ، دیکھا ، وہ چھوٹے قد کے مضبوط پٹھوں والے آدمی تھے ، ان پر کوئی چادر نہیں تھی ۔ انہوں نے اپنے خلاف چار مرتبہ گواہی دی کہ انہوں نے زنا کیا ہے ۔ تو رسول اللہ صلی اللہ علیہ وسلم نے فرمایا : " شاید تم نے ( کچھ اور مثلا : بوس و کنار کیا ہو گا؟ ) " انہوں نے کہا : نہیں ، اللہ کی قسم! اِس بدبخت نے زنا ( ہی ) کیا ہے ۔ کہا : آپ نے اسے رجم کرنے کا حکم دیا ، پھر خطبہ دیا اور فرمایا : " سنو ، جب ہم اللہ کی راہ میں جہاد کے لیے نکلتے ہیں تو ان لوگوں میں سے کوئی پیچھے رہ جاتا ہے ، وہ نسل کشی کے بکرے کی طرح جوش سے آوازیں نکالتا ہے اور ( عورتوں کو آمادہ کرنے کے لیے ) معمولی چیز پیش کرتا ہے ۔ سنو! اللہ کی قسم! اگر اُس نے مجھے ان میں سے کسی ایک کو ( ثبوت سمیت ) میرے قابو میں دیا تو میں اس کو عبرتناک سزا دوں گا
