Hadith 4394 — Livre 28: The Book of Oaths, Muharibin, Qasas (Retaliation), and Diyat (Blood Money)

Rapporté par Al-Mughira ibn Shu’ba : Une femme a tué sa coépouse avec un piquet de tente. Son cas fut présenté au Messager d’Allah ﷺ, qui a jugé que le prix du sang devait être payé par les proches du côté paternel. Comme elle était enceinte, il a décidé qu’un esclave ou une esclave de bonne qualité devait être donné pour l’enfant à naître. Certains proches de la coupable ont dit : « Devons-nous payer pour quelqu’un qui n’a ni mangé, ni bu, ni crié, qui était comme inexistant ? » Le Messager d’Allah ﷺ répondit : « Il parle en phrases rimées comme les Arabes du désert. »

وَحَدَّثَنِي مُحَمَّدُ بْنُ رَافِعٍ، حَدَّثَنَا يَحْيَى بْنُ آدَمَ، حَدَّثَنَا مُفَضَّلٌ، عَنْ مَنْصُورٍ، عَنْ إِبْرَاهِيمَ، عَنْ عُبَيْدِ بْنِ نُضَيْلَةَ، عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ، . أَنَّ امْرَأَةً، قَتَلَتْ ضَرَّتَهَا بِعَمُودِ فُسْطَاطٍ فَأُتِيَ فِيهِ رَسُولُ اللَّهِ صلى الله عليه وسلم فَقَضَى عَلَى عَاقِلَتِهَا بِالدِّيَةِ وَكَانَتْ حَامِلاً فَقَضَى فِي الْجَنِينِ بِغُرَّةٍ . فَقَالَ بَعْضُ عَصَبَتِهَا أَنَدِي مَنْ لاَ طَعِمَ وَلاَ شَرِبَ وَلاَ صَاحَ فَاسْتَهَلَّ وَمِثْلُ ذَلِكَ يُطَلُّ قَالَ فَقَالَ " سَجْعٌ كَسَجْعِ الأَعْرَابِ " .
Traduction anglaise
Al-Mughira b. Shu'ba reported:A woman killed her fellow-wife with a tent-pole. Her case was brought to Allah's Messenger (ﷺ), and he gave judgment that blood-wit should be paid by the relatives (of the offender) on the father's side. And as she was pregnant, he decided regarding her unborn child that a male or a female slave of good quality be given. Some of her offender's) relatives said: Should we make compensation for one who never ate, nor drank, nor made any noise, who was like a nonentity? Thereupon Allah's Messenger (ﷺ) said: He was talking rhymed phrases like the rhymed phrases of desert Arabs

مفضل نے منصور سے ، انہوں نے ابراہیم سے ، انہوں نے عبید بن نضیلہ سے اور انہوں نے حضرت مغیرہ بن شعبہ رضی اللہ عنہ سے روایت کی ، انہوں نے کہا : ایک عورت نے اپنی سوتن کو خیمے کی لکڑی سے قتل کر دیا ، اس ( معاملے ) کو رسول اللہ صلی اللہ علیہ وسلم کے پاس لایا گیا تو آپ نے اس عورت کے عاقلہ پر دیت عائد ہونے کا فیصلہ فرمایا اور چونکہ وہ حاملہ ( بھی ) تھی تو آپ نے پیٹ کے بچے کے بدلے میں ایک غلام ( بطور تاوان دیے جانے ) کا فیصلہ کیا ، اس پر اس کے عصبہ ( جدی مرد رشتہ داروں ) میں سے کسی نے کہا : کیا ہم اس کی دیت دیں جس نے نہ کھایا ، نہ پیا ، نہ چیخا ، نہ چلایا ، اس طرح کا ( خون ) تو رائیگاں ہوتا ہے ، کہا : تو آپ صلی اللہ علیہ وسلم نے فرمایا : " کیا بدوؤں کی سجع جیسی سجع ہے؟
