Hadith 4187 — Livre 24: The Book of Gifts
كتاب الهبة
Rapporté par Jabir (qu’Allah soit satisfait de lui) : L’épouse de Bashir a dit à son mari : « Offre ton esclave à mon fils comme cadeau, et prends le Messager d’Allah ﷺ comme témoin pour moi. » Il est allé voir le Messager d’Allah ﷺ et a dit : « La fille d’untel (son épouse Amra bint Rawaha) m’a demandé d’offrir mon esclave à son fils, et de prendre le Messager d’Allah ﷺ comme témoin. » Le Prophète ﷺ demanda : « Nu'man a-t-il des frères ? » Bashir répondit : « Oui. » Il demanda : « As-tu donné aux autres comme tu as donné à lui ? » Il répondit : « Non. » Le Prophète ﷺ dit alors : « Ce n’est pas juste ; et en vérité, je ne peux être témoin que de ce qui est juste. »

حَدَّثَنَا أَحْمَدُ بْنُ عَبْدِ اللَّهِ بْنِ يُونُسَ، حَدَّثَنَا زُهَيْرٌ، حَدَّثَنَا أَبُو الزُّبَيْرِ، عَنْ جَابِرٍ، قَالَ قَالَتِ امْرَأَةُ بَشِيرٍ انْحَلِ ابْنِي غُلاَمَكَ وَأَشْهِدْ لِي رَسُولَ اللَّهِ صلى الله عليه وسلم . فَأَتَى رَسُولَ اللَّهِ صلى الله عليه وسلم فَقَالَ إِنَّ ابْنَةَ فُلاَنٍ سَأَلَتْنِي أَنْ أَنْحَلَ ابْنَهَا غُلاَمِي وَقَالَتْ أَشْهِدْ لِي رَسُولَ اللَّهِ صلى الله عليه وسلم فَقَالَ " أَلَهُ إِخْوَةٌ " . قَالَ نَعَمْ . قَالَ " أَفَكُلَّهُمْ أَعْطَيْتَ مِثْلَ مَا أَعْطَيْتَهُ " . قَالَ لاَ . قَالَ " فَلَيْسَ يَصْلُحُ هَذَا . وَإِنِّي لاَ أَشْهَدُ إِلاَّ عَلَى حَقٍّ " .
Traduction anglaise
Jabir (Allah be pleased with him) reported that the wife of Bashir said (to her husband):Give to my son your slave as a gift, and make for me Allah's Messenger (ﷺ) a witness He came to Allah's Messenger (ﷺ) and said: The daughter of so and so (his wife Amra bint Rawaha) asked me to give my slave as a gift to her son, and call for me Allah's Messenger (ﷺ) as a witness. Thereupon he (the Holy Prophet) said: Has he (Nu'man) brothers? He (Bashir) said: Yes. He (further) said: Have you given to all others as you have given to him? He said: No. He said: Then it is not fair; and verily I cannot bear witness but only to what is just
Traduction en ourdou
حضرت جابر رضی اللہ عنہ سے روایت ہے ، انہوں نے کہا : حضرت بشیر رضی اللہ عنہ کی بیوی نے کہا : میرے بیٹے کو اپنا غلام ہبہ کر دو اور میرے لیے رسول اللہ صلی اللہ علیہ وسلم کو گواہ بناؤ ۔ وہ رسول اللہ صلی اللہ علیہ وسلم کے پاس آئے اور کہا : فلاں کی بیٹی نے مجھ سے مطالبہ کیا ہے کہ میں اس کے بیٹے کو اپنا غلام ہبہ کر دوں اور اس نے کہا ہے : میرے لیے ( اس پر ) رسول اللہ صلی اللہ علیہ وسلم کو گواہ بناؤ ۔ تو آپ نے پوچھا : " کیا اس کے اور بھائی ہیں؟ " انہوں نے جواب دیا : جی ہاں ۔ آپ نے پوچھا : " کیا ان سب کو بھی تم نے اسی طرح عطیہ دیا ہے جس طرح اسے دیا ہے؟ " انہوں نے جواب دیا : نہیں ۔ آپ نے فرمایا : " یہ درست نہیں اور میں صرف حق پر گواہ بنتا ہوں
