Hadith 3654 — Livre 18: The Book of Divorce
كتاب الطلاق
Rapporté par Ibn ‘Umar رضي الله عنه : J’ai divorcé de ma femme du vivant du Messager d’Allah ﷺ alors qu’elle avait ses règles. ‘Umar رضي الله عنه en a parlé au Messager d’Allah ﷺ, qui a dit : « Ordonne-lui de la reprendre et de la laisser (dans cet état) jusqu’à ce qu’elle soit purifiée. Ensuite, qu’elle ait ses règles une seconde fois, et quand elle sera purifiée, alors il pourra la divorcer définitivement avant d’avoir eu de rapports avec elle, ou bien la garder. C’est la ‘idda (la période prescrite) qu’Allah a ordonnée pour le divorce des femmes. » ‘Ubaidullah rapporte : J’ai demandé à Nafi’ : « Qu’en est-il de ce divorce (prononcé pendant la ‘idda) ? » Il a répondu : « Il a été compté. »

حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ نُمَيْرٍ، حَدَّثَنَا أَبِي، حَدَّثَنَا عُبَيْدُ اللَّهِ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، قَالَ طَلَّقْتُ امْرَأَتِي عَلَى عَهْدِ رَسُولِ اللَّهِ صلى الله عليه وسلم وَهْىَ حَائِضٌ فَذَكَرَ ذَلِكَ عُمَرُ لِرَسُولِ اللَّهِ صلى الله عليه وسلم فَقَالَ " مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ لْيَدَعْهَا حَتَّى تَطْهُرَ ثُمَّ تَحِيضَ حَيْضَةً أُخْرَى فَإِذَا طَهُرَتْ فَلْيُطَلِّقْهَا قَبْلَ أَنْ يُجَامِعَهَا أَوْ يُمْسِكْهَا فَإِنَّهَا الْعِدَّةُ الَّتِي أَمَرَ اللَّهُ أَنْ يُطَلَّقَ لَهَا النِّسَاءُ " . قَالَ عُبَيْدُ اللَّهِ قُلْتُ لِنَافِعٍ مَا صَنَعَتِ التَّطْلِيقَةُ قَالَ وَاحِدَةٌ اعْتَدَّ بِهَا .
Traduction anglaise
Ibn Umar (Allah be pleased with them) reported:I divorced my wife during the lifetime of Allah's Messenger (ﷺ) when she was in the state of menses. 'Umar (Allah be pleased with him) made a mention of it to Allah's Messenger (ﷺ), whereupon he said: Command him to take her back and leave her (in that state) until she is purified. Then (let her) enter the period of second menses, and when she is purified, then divorce her (finally) before having a sexual intercourse with her, or retain her (finally). That is the 'Idda (the prescribed period) which Allah commanded (to be kept in view) while divorcing the women. 'Ubaidullah reported: I said to Nafi': What became of that divorce (pronounced within 'Idda)? He said: It was as one which she counted

عبداللہ بن نمیر نے ہمیں حدیث بیان کی ، ( کہا : ) ہمیں عبیداللہ نے نافع سے حدیث بیان کی ، انہوں نے حضرت ابن عمر رضی اللہ عنہ سے روایت کی ، انہوں نے کہا : میں نے رسول اللہ صلی اللہ علیہ وسلم کے عہد مبارک میں اپنی بیوی کو جب وہ حیض کی حالت میں تھی ، طلاق دے دی ۔ حضرت عمر رضی اللہ عنہ نے یہ بات رسول اللہ صلی اللہ علیہ وسلم کو بتائی تو آپ نے فرمایا : "" اسے حکم دو کہ اس سے رجوع کرے پھر اسے ( اپنے پاس رکھ ) چھوڑے حتی کہ وہ پاک ہو جائے ، پھر اسے دوسرا حیض آئے ، اس کے بعد جب وہ پاک ہو جائے تو مباشرت کرنے سے پہلے اسے طلاق دے یا اسے اپنے پاس رکھے ۔ بلاشبہ یہی وہ عدت ہے جس کا اللہ تعالیٰ نے حکم دیا ہے کہ اس کے مطابق عورتوں کو طلاق دی جائے ۔ "" عبیداللہ نے کہا : میں نے نافع سے پوچھا : طلاق کا کیا کیا گیا؟ انہوں نے جواب دیا : وہ ایک تھی ، اس کو شمار کیا گیا
