كتاب الحيل
Rapporté par 'Abdullah : Nafi m’a raconté que 'Abdullah a dit que le Messager d’Allah (ﷺ) a interdit le Shighar. J’ai demandé à Nafi' : « Qu’est-ce que le Shighar ? » Il a répondu : « C’est marier la fille d’un homme et donner sa propre fille en mariage à cet homme (en même temps) sans Mahr (dot) dans les deux cas ; ou marier la sœur d’un homme et donner sa propre sœur en mariage à cet homme sans Mahr. » Certaines personnes ont dit : « Si quelqu’un, par ruse, se marie selon le Shighar, le mariage est valide mais la condition est illégale. » Le même savant a dit à propos du Mut'a : « Le mariage est invalide et sa condition est illégale. » D’autres ont dit : « Le Mut'a et le Shighar sont permis mais la condition est illégale. »

حَدَّثَنَا مُسَدَّدٌ، حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ، عَنْ عُبَيْدِ اللَّهِ، قَالَ حَدَّثَنِي نَافِعٌ، عَنْ عَبْدِ اللَّهِ ـ رضى الله عنه ـ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم نَهَى عَنِ الشِّغَارِ. قُلْتُ لِنَافِعٍ مَا الشِّغَارُ قَالَ يَنْكِحُ ابْنَةَ الرَّجُلِ وَيُنْكِحُهُ ابْنَتَهُ بِغَيْرِ صَدَاقٍ، وَيَنْكِحُ أُخْتَ الرَّجُلِ وَيُنْكِحُهُ أُخْتَهُ بِغَيْرِ صَدَاقٍ. وَقَالَ بَعْضُ النَّاسِ إِنِ احْتَالَ حَتَّى تَزَوَّجَ عَلَى الشِّغَارِ، فَهْوَ جَائِزٌ، وَالشَّرْطُ بَاطِلٌ. وَقَالَ فِي الْمُتْعَةِ النِّكَاحُ فَاسِدٌ، وَالشَّرْطُ بَاطِلٌ. وَقَالَ بَعْضُهُمُ الْمُتْعَةُ وَالشِّغَارُ جَائِزٌ، وَالشَّرْطُ بَاطِلٌ.
Traduction anglaise
Narrated 'Abdullah: Nafi narrated to me that 'Abdullah said that Allah's Messenger (ﷺ) forbade the Shighar. I asked Nafi', "What is the Shighar?" He said, "It is to marry the daughter of a man and marry one's daughter to that man (at the same time) without Mahr (in both cases); or to marry the sister of a man and marry one's own sister to that man without Mahr." Some people said, "If one, by a trick, marries on the basis of Shighar, the marriage is valid but its condition is illegal." The same scholar said regarding Al-Mut'a, "The marriage is invalid and its condition is illegal." Some others said, "The Mut'a and the Shighar are permissible but the condition is illegal

ہم سے مسدد نے بیان کیا، انہوں نے کہا ہم سے یحییٰ بن سعید قطان نے بیان کیا، ان سے عبیداللہ نے بیان کیا، انہوں نے کہا کہ مجھ سے نافع نے بیان کیا، اور ان سے عبداللہ بن مسعود رضی اللہ عنہ نے کہ رسول اللہ صلی اللہ علیہ وسلم نے شغار سے منع فرمایا۔ میں نے نافع سے پوچھا شغار کیا ہے؟ انہوں نے کہا یہ کہ کوئی شخص بغیر مہر کسی کی لڑکی سے نکاح کرتا ہے یا اس سے بغیر مہر کے اپنی لڑکی کا نکاح کرتا ہے پس اس کے سوا کوئی مہر مقرر نہ ہو اور بعض لوگوں نے کہا اگر کسی نے حیلہ کر کے نکاح شغار کر لیا تو نکاح کا عقد درست ہو گا اور شرط لغو ہو گی ( اور ہر ایک کو مہر مثل عورت کا ادا کرنا ہو گا ) اور ہاں بعض لوگوں نے متعہ میں کہا ہے کہ وہاں نکاح بھی فاسد ہے اور شرط بھی باطل ہے اور بعض یہ کہتے ہیں کہ متعہ اور شغار دونوں جائز ہوں گے اور شرط باطل ہو گی۔
