Rapporté par Abu Huraira : Le Prophète (ﷺ) a dit : Il n’y a pas de Diya pour une personne blessée ou tuée par un animal (qui se déplace sans surveillance), et de même, il n’y a pas de Diya pour celui qui tombe et meurt dans un puits, ni pour celui qui meurt dans une mine. En ce qui concerne l’Ar-Rikaz (richesses enfouies), un cinquième doit revenir à l’État

حَدَّثَنَا مُسْلِمٌ، حَدَّثَنَا شُعْبَةُ، عَنْ مُحَمَّدِ بْنِ زِيَادٍ، عَنْ أَبِي هُرَيْرَةَ ـ رضى الله عنه ـ عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ " الْعَجْمَاءُ عَقْلُهَا جُبَارٌ، وَالْبِئْرُ جُبَارٌ، وَالْمَعْدِنُ جُبَارٌ، وَفِي الرِّكَازِ الْخُمُسُ ".
Traduction anglaise
Narrated Abu Huraira:The Prophet (ﷺ) said, "There is no Diya for a person injured or killed by an animal (going about without somebody to control it) and similarly, there is no Diya for the one who falls and dies in a well, and also the one who dies in a mine. As regards the Ar-Rikaz (buried wealth), one-fifth thereof is for the state
Traduction en ourdou
ہم سے مسلم بن ابراہیم نے بیان کیا، کہا ہم سے شعبہ نے، انہوں نے محمد بن زیاد سے، انہوں نے ابوہریرہ رضی اللہ عنہ سے، انہوں نے نبی کریم صلی اللہ علیہ وسلم سے، آپ صلی اللہ علیہ وسلم نے فرمایا ”بےزبان جانور کسی کو زخمی کرے تو اس کی دیت کچھ نہیں ہے، اسی طرح کان میں کام کرنے سے کوئی نقصان پہنچے، اسی طرح کنویں میں کام کرنے سے اور جو کافروں کا مال دفن کیا ہوا ملے اس میں پانچواں حصہ سرکار میں لیا جائے گا۔“
