Hadith 5139 — Livre 67: Wedlock, Marriage (Nikaah)
كتاب النكاح
Rapporté par `Abdur-Rahman bin Yazid et Majammi bin Yazid : Même récit que ci-dessus : Un homme appelé Khidam a marié sa fille à quelqu’un sans son accord. « Si vous craignez de ne pas être justes envers les orphelines, alors épousez d’autres femmes de votre choix. » (4.3) Et si quelqu’un dit au tuteur d’une femme : « Marie-moi avec telle ou telle », et que le tuteur reste silencieux ou lui demande : « Qu’as-tu à offrir ? », et que l’autre répond : « J’ai telle et telle chose (comme dot) », ou garde le silence, puis que le tuteur dit : « Je t’ai marié avec elle », alors le mariage est valide. Ce récit a été rapporté par Sahl d’après le Prophète

حَدَّثَنَا إِسْحَاقُ، أَخْبَرَنَا يَزِيدُ، أَخْبَرَنَا يَحْيَى، أَنَّ الْقَاسِمَ بْنَ مُحَمَّدٍ، حَدَّثَهُ أَنَّ عَبْدَ الرَّحْمَنِ بْنَ يَزِيدَ وَمُجَمِّعَ بْنَ يَزِيدَ حَدَّثَاهُ أَنَّ رَجُلاً يُدْعَى خِذَامًا أَنْكَحَ ابْنَةً لَهُ. نَحْوَهُ.
Traduction anglaise
Narrated `Abdur-Rahman bin Yazid and Majammi bin Yazid:The same ,Hadith above: A man called Khidam married a daughter of his (to somebody) against her consent. 'If you fear that you shall not be able to deal justly with the orphan girls then marry (other) women of your choice.' (4.3) And if somebody says to the guardian (of a woman), "Marry me to so-and-so," and the guardian remained silent or said to him, "What have you got?" And the other said, "I have so much and so much (Mahr)," or kept quiet, and then the guardian said, "I have married her to you," then the marriage is valid (legal). This narration was told by Sahl on the authority of the Prophet

ہم سے اسحاق بن راہویہ نے بیان کیا، کہا ہم کو یزید بن ہارون نے خبر دی، کہا ہم کو یحییٰ بن سعید انصاری نے خبر دی، ان سے قاسم بن محمد نے بیان کیا، ان سے عبدالرحمٰن بن یزید اور مجمع بن یزید نے بیان کیا کہ خذام نامی ایک صحابی نے اپنی لڑکی کا نکاح کر دیا تھا۔ پھر پچھلی حدیث کی طرح بیان کیا۔
