Rapporté par Az-Zuhri : ‘Urwa a dit : ‘Aisha m’a raconté que le Messager d’Allah (ﷺ) examinait les femmes émigrantes. On nous a aussi dit que lorsque Allah a révélé l’ordre que les musulmans devaient rendre aux polythéistes ce qu’ils avaient dépensé pour leurs épouses qui avaient émigré (après avoir embrassé l’islam), et que les musulmans ne devaient pas garder de femmes non-croyantes comme épouses, ‘Umar a divorcé de deux de ses femmes : Qariba, la fille d’Abu Umayya, et la fille de Jarwal Al-Khuza’i. Plus tard, Mu‘awiya a épousé Qariba et Abu Jahm a épousé l’autre. Lorsque les polythéistes ont refusé de rembourser ce que les musulmans avaient dépensé pour leurs femmes, Allah a révélé : « Et si l’une de vos épouses part chez les non-croyants et qu’une femme de l’autre camp vient à vous, alors payez à ceux dont les femmes sont parties l’équivalent de ce qu’ils avaient dépensé (pour la dot). » (60.11) Ainsi, Allah a ordonné que le musulman dont la femme est partie reçoive, en compensation de la dot, une part prise sur la dot des femmes polythéistes qui avaient émigré en quittant leurs maris. Nous ne connaissons aucune femme émigrante qui ait quitté l’islam après l’avoir embrassé. On nous a aussi dit qu’Abu Basir bin Asid Ath-Thaqafi est venu voir le Prophète (ﷺ) comme musulman émigrant pendant la trêve. Al-Akhnas bin Shariq a écrit au Prophète (ﷺ) pour lui demander de rendre Abu Basir

وَقَالَ عُقَيْلٌ عَنِ الزُّهْرِيِّ، قَالَ عُرْوَةُ فَأَخْبَرَتْنِي عَائِشَةُ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم كَانَ يَمْتَحِنُهُنَّ، وَبَلَغَنَا أَنَّهُ لَمَّا أَنْزَلَ اللَّهُ تَعَالَى أَنْ يَرُدُّوا إِلَى الْمُشْرِكِينَ مَا أَنْفَقُوا عَلَى مَنْ هَاجَرَ مِنْ أَزْوَاجِهِمْ، وَحَكَمَ عَلَى الْمُسْلِمِينَ، أَنْ لاَ يُمَسِّكُوا بِعِصَمِ الْكَوَافِرِ، أَنَّ عُمَرَ طَلَّقَ امْرَأَتَيْنِ قَرِيبَةَ بِنْتَ أَبِي أُمَيَّةَ، وَابْنَةَ جَرْوَلٍ الْخُزَاعِيِّ، فَتَزَوَّجَ قَرِيبَةَ مُعَاوِيَةُ، وَتَزَوَّجَ الأُخْرَى أَبُو جَهْمٍ، فَلَمَّا أَبَى الْكُفَّارُ أَنْ يُقِرُّوا بِأَدَاءِ مَا أَنْفَقَ الْمُسْلِمُونَ عَلَى أَزْوَاجِهِمْ، أَنْزَلَ اللَّهُ تَعَالَى {وَإِنْ فَاتَكُمْ شَىْءٌ مِنْ أَزْوَاجِكُمْ إِلَى الْكُفَّارِ فَعَاقَبْتُمْ} وَالْعَقِبُ مَا يُؤَدِّي الْمُسْلِمُونَ إِلَى مَنْ هَاجَرَتِ امْرَأَتُهُ مِنَ الْكُفَّارِ، فَأَمَرَ أَنْ يُعْطَى مَنْ ذَهَبَ لَهُ زَوْجٌ مِنَ الْمُسْلِمِينَ مَا أَنْفَقَ مِنْ صَدَاقِ نِسَاءِ الْكُفَّارِ اللاَّئِي هَاجَرْنَ، وَمَا نَعْلَمُ أَحَدًا مِنَ الْمُهَاجِرَاتِ ارْتَدَّتْ بَعْدَ إِيمَانِهَا. وَبَلَغَنَا أَنَّ أَبَا بَصِيرِ بْنَ أَسِيدٍ الثَّقَفِيَّ قَدِمَ عَلَى النَّبِيِّ صلى الله عليه وسلم مُؤْمِنًا مُهَاجِرًا فِي الْمُدَّةِ، فَكَتَبَ الأَخْنَسُ بْنُ شَرِيقٍ إِلَى النَّبِيِّ صلى الله عليه وسلم يَسْأَلُهُ أَبَا بَصِيرٍ، فَذَكَرَ الْحَدِيثَ.
Traduction anglaise
Narrated Az-Zuhri:`Urwa said, "Aisha told me that Allah's Messenger (ﷺ) used to examine the women emigrants. We have been told also that when Allah revealed the order that the Muslims should return to the pagans what they had spent on their wives who emigrated (after embracing Islam) and that the Muslims should not keep unbelieving women as their wives, `Umar divorced two of his wives, Qariba, the daughter of Abu Umayyah and the daughter of Jarwal Al-Khuza`i. Later on Mu`awiya married Qariba and Abu Jahm married the other." When the pagans refused to pay what the Muslims had spent on their wives, Allah revealed: "And if any of your wives have gone from you to the unbelievers and you have an accession (by the coming over of a woman from the other side) (then pay to those whose wives have gone) the equivalent of what they had spent (on their Mahr)." (60.11) So, Allah ordered that the Muslim whose wife has gone, should be given, as a compensation of the Mahr he had given to his wife, from the Mahr of the wives of the pagans who had emigrated deserting their husbands. We do not know any of the women emigrants who deserted Islam after embracing it. We have also been told that Abu Basir bin Asid Ath-Thaqafi came to the Prophet (ﷺ) as a Muslim emigrant during the truce. Al-Akhnas bin Shariq wrote to the Prophet (ﷺ) requesting him to return Abu Basir

عقیل نے زہری سے بیان کیا ‘ ان سے عروہ نے اور ان سے عائشہ رضی اللہ عنہا نے کہ رسول اللہ صلی اللہ علیہ وسلم عورتوں کا ( جو مکہ سے مسلمان ہونے کی وجہ سے ہجرت کر کے مدینہ آتی تھیں ) امتحان لیتے تھے ( زہری نے ) بیان کیا کہ ہم تک یہ روایت پہنچی ہے کہ جب اللہ تعالیٰ نے یہ آیت نازل فرمائی کہ مسلمان وہ سب کچھ ان مشرکوں کو واپس کر دیں جو انہوں نے اپنی ان بیویوں پر خرچ کیا ہو جو ( اب مسلمان ہو کر ) ہجرت کر آئی ہیں اور مسلمانوں کو حکم دیا کہ کافر عورتوں کو اپنے نکاح میں نہ رکھیں تو عمر رضی اللہ عنہ نے اپنی دو بیویوں قریبہ بنت ابی امیہ اور ایک جرول خزاعی کی لڑکی کو طلاق دے دی۔ بعد میں قریبہ سے معاویہ رضی اللہ عنہ نے شادی کر لی تھی ( کیونکہ اس وقت معاویہ رضی اللہ عنہ مسلمان نہیں ہوئے تھے ) اور دوسری بیوی سے ابوجہم نے شادی کر لی تھی لیکن جب کفار نے مسلمانوں کے ان اخراجات کو ادا کرنے سے انکار کیا جو انہوں نے اپنی ( کافرہ ) بیویوں پر کئے تھے تو اللہ تعالیٰ نے یہ آیت نازل فرمائی «وإن فاتكم شىء من أزواجكم إلى الكفار فعاقبتم» ”اور تمہاری بیویوں میں سے کوئی کافروں کے ہاں چلی گئی تو وہ معاوضہ تم خود ہی لے لو۔“ یہ وہ معاوضہ تھا جو مسلمان کفار میں سے اس شخص کو دیتے جس کی بیوی ہجرت کر کے ( مسلمان ہونے کے بعد کسی مسلمان کے نکاح میں آ گئی ہو ) پس اللہ نے اب یہ حکم دیا کہ جس مسلمان کی بیوی مرتد ہو کر ( کفار کے یہاں ) چلی جائے اس کے ( مہر و نفقہ کے ) اخراجات ان کفار کی عورتوں کے مہر سے ادا کر دئیے جائیں جو ہجرت کر کے آ گئی ہیں ( اور کسی مسلمان نے ان سے نکاح کر لیا ہے ) اگرچہ ہمارے پاس اس کا کوئی ثبوت نہیں کہ کوئی مہاجرہ بھی ایمان کے بعد مرتد ہوئی ہوں اور ہمیں یہ روایت بھی معلوم ہوئی کہ ابوبصیر بن اسید ثقفی رضی اللہ عنہ جب نبی کریم صلی اللہ علیہ وسلم کی خدمت میں مومن و مہاجر کی حیثیت سے معاہدہ کی مدت کے اندر ہی حاضر ہوئے تو اخنس بن شریق نے نبی کریم صلی اللہ علیہ وسلم کو ایک تحریر لکھی جس میں اس نے ( ابوبصیر رضی اللہ عنہ کی واپسی کا ) مطالبہ آپ صلی اللہ علیہ وسلم سے کیا تھا۔ پھر انہوں نے حدیث پوری بیان کی۔
