Rapporté par Ibn `Umar : Le Prophète (ﷺ) a dit : « Celui qui affranchit sa part d'un esclave et qui a assez d'argent pour payer le reste du prix de cet esclave (après une estimation juste), alors il doit l'affranchir en donnant le reste du prix aux autres copropriétaires. » Nafi` a ajouté : « Sinon, l'esclave est partiellement libre. » Aiyub n'est pas sûr si cette dernière phrase a été dite par Nafi` ou si elle fait partie du hadith

حَدَّثَنَا أَبُو النُّعْمَانِ، حَدَّثَنَا حَمَّادٌ، عَنْ أَيُّوبَ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ ـ رضى الله عنهما ـ عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ " مَنْ أَعْتَقَ نَصِيبًا لَهُ فِي مَمْلُوكٍ أَوْ شِرْكًا لَهُ فِي عَبْدٍ، وَكَانَ لَهُ مِنَ الْمَالِ مَا يَبْلُغُ قِيمَتَهُ بِقِيمَةِ الْعَدْلِ، فَهْوَ عَتِيقٌ ". قَالَ نَافِعٌ وَإِلاَّ فَقَدْ عَتَقَ مِنْهُ مَا عَتَقَ. قَالَ أَيُّوبُ لاَ أَدْرِي أَشَىْءٌ قَالَهُ نَافِعٌ، أَوْ شَىْءٌ فِي الْحَدِيثِ.
Traduction anglaise
Narrated Ibn `Umar:The Prophet (ﷺ) said, "He who manumits his share of a slave and has money sufficient to free the remaining portion of that slave's price (justly estimated) then he should manumit him (by giving the rest of his price to the other co-owners)." Nafi` added, "Otherwise the slave is partially free." Aiyub is not sure whether the last statement was said by Nafi` or it was a part of the Hadith

ہم سے ابوالنعمان نے بیان کیا، کہا ہم سے حماد بن زید نے بیان کیا، ان سے ایوب سختیانی نے، ان سے نافع نے اور ان سے ابن عمر رضی اللہ عنہما نے کہ نبی کریم صلی اللہ علیہ وسلم نے فرمایا جس نے کسی ( ساجھے ) غلام کا اپنا حصہ آزاد کر دیا۔ یا ( آپ صلی اللہ علیہ وسلم نے ) یہ الفاظ فرمائے «شركا له في عبد» ( شک راوی حدیث ایوب سختیانی کو ہوا ) اور اس کے پاس اتنا مال بھی تھا جس سے پورے غلام کی مناسب قیمت ادا کی جا سکتی تھی تو وہ غلام پوری طرح آزاد سمجھا جائے گا۔ ( باقی حصوں کی قیمت اس کو دینی ہو گی ) نافع نے بیان کیا ورنہ اس کا جو حصہ آزاد ہو گیا بس وہ آزاد ہو گیا۔ ایوب نے کہا کہ مجھے معلوم نہیں یہ ( آخری ٹکڑا ) خود نافع نے اپنی طرف سے کہا تھا یا یہ بھی حدیث میں شامل ہے۔
