Rapporté par Nafi` : Ibn `Umar a dit : « Le Messager d’Allah (ﷺ) a dit : ‘Si quelqu’un affranchit sa part d’un esclave possédé en commun, et qu’il peut payer le prix des autres parts selon la valeur de l’esclave, alors l’esclave sera totalement affranchi ; sinon, il sera affranchi en partie.’ » (Aiyub, un des rapporteurs, n’est pas sûr si la phrase « sinon, il sera affranchi en partie » a été dite par Nafi` ou par le Prophète)

حَدَّثَنَا عِمْرَانُ بْنُ مَيْسَرَةَ، حَدَّثَنَا عَبْدُ الْوَارِثِ، حَدَّثَنَا أَيُّوبُ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ ـ رضى الله عنهما ـ قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " مَنْ أَعْتَقَ شِقْصًا لَهُ مِنْ عَبْدٍ ـ أَوْ شِرْكًا أَوْ قَالَ نَصِيبًا ـ وَكَانَ لَهُ مَا يَبْلُغُ ثَمَنَهُ بِقِيمَةِ الْعَدْلِ، فَهْوَ عَتِيقٌ، وَإِلاَّ فَقَدْ عَتَقَ مِنْهُ مَا عَتَقَ ". قَالَ لاَ أَدْرِي قَوْلُهُ عَتَقَ مِنْهُ مَا عَتَقَ. قَوْلٌ مِنْ نَافِعٍ أَوْ فِي الْحَدِيثِ عَنِ النَّبِيِّ صلى الله عليه وسلم.
Traduction anglaise
Narrated Nafi`:Ibn `Umar said, "Allah's Messenger (ﷺ) said, 'If one manumits his share of a jointly possessed slave, and can afford the price of the other shares according to the adequate price of the slave, the slave will be completely manumitted; otherwise he will be partially manumitted.' " (Aiyub, a sub-narrator is not sure whether the saying " ... otherwise he will be partially manumitted" was said by Nafi` or the Prophet)
Traduction en ourdou
ہم سے عمران بن میسرہ ابوالحسن بصری نے بیان کیا، کہا کہ ہم سے عبدالوارث بن سعید نے بیان کیا، کہا ہم سے ایوب سختیانی نے، کہا ان سے نافع نے اور ان سے عبداللہ بن عمر رضی اللہ عنہما نے کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا جو شخص مشترک ( ساجھے ) کے غلام میں اپنا حصہ آزاد کر دے اور اس کے پاس سارے غلام کی قیمت کے موافق مال ہو تو وہ پورا آزاد ہو جائے گا۔ اگر اتنا مال نہ ہو تو بس جتنا حصہ اس کا تھا اتنا ہی آزاد ہوا۔ ایوب نے کہا کہ یہ مجھے معلوم نہیں کہ روایت کا یہ آخری حصہ ”غلام کا وہی حصہ آزاد ہو گا جو اس نے آزاد کیا ہے“ یہ نافع کا اپنا قول ہے یا نبی کریم صلی اللہ علیہ وسلم کی حدیث میں داخل ہے۔
