كتاب البيوع
Rapporté par Ibn `Umar : Le Messager d'Allah (ﷺ) a dit : « L'acheteur et le vendeur ont le choix d'annuler ou de confirmer la vente tant qu'ils sont encore ensemble ; et sauf s'ils se séparent ou que l'un d'eux donne à l'autre le choix de garder ou de rendre la marchandise et qu'une décision est prise à ce moment-là, dans ce cas la vente est considérée comme définitive. S'ils se séparent après la vente et qu'aucun d'eux ne l'a annulée, alors la vente est considérée comme définitive. »

حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا اللَّيْثُ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ ـ رضى الله عنهما ـ عَنْ رَسُولِ اللَّهِ صلى الله عليه وسلم أَنَّهُ قَالَ " إِذَا تَبَايَعَ الرَّجُلاَنِ فَكُلُّ وَاحِدٍ مِنْهُمَا بِالْخِيَارِ، مَا لَمْ يَتَفَرَّقَا، وَكَانَا جَمِيعًا، أَوْ يُخَيِّرُ أَحَدُهُمَا الآخَرَ فَتَبَايَعَا عَلَى ذَلِكَ، فَقَدْ وَجَبَ الْبَيْعُ، وَإِنْ تَفَرَّقَا بَعْدَ أَنْ يَتَبَايَعَا، وَلَمْ يَتْرُكْ وَاحِدٌ مِنْهُمَا الْبَيْعَ، فَقَدْ وَجَبَ الْبَيْعُ ".
Traduction anglaise
Narrated Ibn `Umar:Allah's Messenger (ﷺ) said, "Both the buyer and the seller have the option of canceling or confirming the bargain, as long as they are still together; and unless they separate or one of them gives the other the option of keeping or returning the things and a decision is concluded then, in which case the bargain is considered final. If they separate after the bargain and none of them has rejected it, then the bargain is rendered final
Traduction en ourdou
ہم سے قتیبہ نے بیان کیا، کہا کہ ہم سے لیث نے بیان کیا، ان سے نافع نے اور ان سے ابن عمر رضی اللہ عنہما نے کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا، جب دو شخصوں نے خرید و فروخت کی تو جب تک وہ دونوں جدا نہ ہو جائیں، انہیں ( بیع کو توڑ دینے کا ) اختیار باقی رہتا ہے۔ یہ اس صورت میں کہ دونوں ایک ہی جگہ رہیں، لیکن اگر ایک نے دوسرے کو پسند کرنے کے لیے کہا اور اس شرط پر بیع ہوئی، اور دونوں نے بیع کا قطعی فیصلہ کر لیا، تو بیع اسی وقت منعقد ہو جائے گی۔ اسی طرح اگر دونوں فریق بیع کے بعد ایک دوسرے سے جدا ہو گئے، اور بیع سے کسی فریق نے بھی انکار نہیں کیا، تو بھی بیع لازم ہو جاتی ہے۔
