Hadith 2250 — Livre 13: Divorce (Kitab Al-Talaq)

La tradition mentionnée ci-dessus a aussi été transmise par Sahl ibn Sa’d Al Sa’idi par une autre chaîne de narrateurs. Cette version précise : « Il l’a divorcée trois fois devant le Messager d’Allah ﷺ. Le Messager d’Allah ﷺ l’a appliqué, et ce qui a été fait devant le Prophète ﷺ est une sunna (comportement à suivre). » Sahl a dit : « J’ai assisté à cela devant le Messager d’Allah ﷺ. Par la suite, la sunna concernant ceux qui s’échangent les malédictions a été établie : ils sont séparés à jamais et ne peuvent plus jamais être réunis. »

حَدَّثَنَا أَحْمَدُ بْنُ عَمْرِو بْنِ السَّرْحِ، حَدَّثَنَا ابْنُ وَهْبٍ، عَنْ عِيَاضِ بْنِ عَبْدِ اللَّهِ الْفِهْرِيِّ، وَغَيْرِهِ، عَنِ ابْنِ شِهَابٍ، عَنْ سَهْلِ بْنِ سَعْدٍ، فِي هَذَا الْخَبَرِ قَالَ فَطَلَّقَهَا ثَلاَثَ تَطْلِيقَاتٍ عِنْدَ رَسُولِ اللَّهِ صلى الله عليه وسلم فَأَنْفَذَهُ رَسُولُ اللَّهِ صلى الله عليه وسلم وَكَانَ مَا صُنِعَ عِنْدَ النَّبِيِّ صلى الله عليه وسلم سُنَّةً . قَالَ سَهْلٌ حَضَرْتُ هَذَا عِنْدَ رَسُولِ اللَّهِ صلى الله عليه وسلم فَمَضَتِ السُّنَّةُ بَعْدُ فِي الْمُتَلاَعِنَيْنِ أَنْ يُفَرَّقَ بَيْنَهُمَا ثُمَّ لاَ يَجْتَمِعَانِ أَبَدًا .
Traduction anglaise
The tradition mentioned above has also been transmitted by Sahl bin Sa’d Al Sa’idi through a different chain of narrators. This version has “He divorced her three times before the Messenger of Allah (ﷺ). The Messenger of Allah (ﷺ) implemented it and what is done before the Prophet (ﷺ) is sunnah(model behavior of the Prophet). Sahl said “I attended this before the Messenger of Allah(ﷺ). Afterwards the sunnah about those who invoked curses on each other was established that they (the spouses) were separated from each other and they would never be united.”

اس سند سے بھی سہل بن سعد رضی اللہ عنہما سے یہی حدیث مروی ہے اس میں ہے: انہوں ( عاصم بن عدی ) نے رسول اللہ صلی اللہ علیہ وسلم کی موجودگی میں اسے تین طلاق دے دی تو رسول صلی اللہ علیہ وسلم نے اسے نافذ فرما دیا، اور جو کام آپ کی موجودگی میں کیا گیا ہو وہ سنت ہے۔ سہل رضی اللہ عنہ کا بیان ہے کہ رسول اللہ صلی اللہ علیہ وسلم کے پاس اس وقت میں موجود تھا، اس کے بعد لعان کرنے والے مرد اور عورت کے سلسلہ میں طریقہ ہی یہ ہو گیا کہ انہیں جدا کر دیا جائے، اور وہ دونوں پھر کبھی اکٹھے نہ ہوں۔
